AVOLYA Community
Community guidelines
The community thrives when everyone feels safe. These rules apply to all content you share there: posts, replies, reactions, activities, events and your own food products (e.g. products added via barcode). The community is provided by WiAd UG (haftungsbeschränkt), Rosengarten 14, 23730 Neustadt in Holstein (“we”).
1. Who sees what
- Your posts, replies, reactions, activities (type, distance, duration, calories) and events can be seen by all logged-in members – under your display name “First name L.”.
- Only you can see a recorded GPS route. Others only see the distance, duration and calories.
- Simply taking part in the community allows conclusions to be drawn about weight-loss treatment. So only share what you really want to share.
- You can delete your own posts, replies, activities and events yourself at any time. If you withdraw your consent to the community (Account › Manage consents), we will remove your community content.
- The community is no substitute for medical advice. Please direct any questions about your treatment to your doctor from our team of doctors.
2. What is not allowed
- Illegal content, e.g. insults, threats, incitement to hatred, copyright infringements.
- Trading in medicines: offering, selling, swapping, giving away or otherwise passing on medicines or pens – including “leftover” pens.
- Dosing advice: tips on dosage, increasing the dose, stretching or splitting pens, and any other instructions on using medicines.
- Third parties' health data, e.g. other people's diagnoses, weight or medication, and any other personal data of third parties without their consent.
- Advertising: sales offers, affiliate links, self-promotion, spam.
- Harassment: bullying, body shaming, discrimination, sexual innuendo, repeated unwanted contact.
- Misleading information, such as deliberately false nutritional values for your own products or made-up activities.
3. Moderation
We do not check content in advance. Reported or suspicious content is reviewed manually by the AVOLYA team – no automated decisions are made. If content breaches these rules or applicable law, we may:
- remove the content,
- restrict its visibility,
- suspend the account from the community temporarily or permanently.
We choose the least severe measure that is sufficient, taking into account the severity, frequency and intent of the breach as well as the rights of everyone involved.
4. Statement of reasons to you (Art. 17 DSA)
If we restrict any of your content or your account, we will send you a statement of reasons by email: what we have done and for how long, the facts and circumstances on which this is based, whether it was taken in response to a notice, that no automated means were used, which rule or legal provision the content infringes, and what possibilities for redress are available to you.
5. Reporting content (Art. 16 DSA)
You can report any post, reply, activity or event directly in the community using “Report”. If you do not take part in the community, you can submit a notice by email to hallo@avolya.de or via the contact form (topic “Report illegal content”). A notice must include:
- the location – in the community we add this automatically; otherwise e.g. the date, display name and exact wording,
- an explanation of the reasons why the content is illegal or breaches these rules,
- your name and email address (not required for notices concerning child sexual abuse material),
- your statement confirming your bona fide belief that the information you have provided is accurate and complete.
We will confirm receipt, process the notice promptly and diligently and inform you of our decision. We will only reveal to the reported person who submitted the notice if this is strictly necessary in exceptional cases (Art. 17(3) DSA). If someone repeatedly submits manifestly unfounded notices, we may, after issuing a prior warning, suspend the processing of their notices for a period of time.
6. Decisions and redress
If you disagree with a decision – whether it concerns your content or something you reported – write to us at hallo@avolya.de. We will then review the decision again. Irrespective of this, you are free to take the matter to the ordinary courts at any time.
As a micro enterprise, we are not obliged to participate in proceedings before an out-of-court dispute settlement body under Art. 21 DSA (Art. 19 DSA), and we do not participate in them.
7. Threat to life or safety (Art. 18 DSA)
If we become aware of information giving rise to a suspicion of a criminal offence involving a threat to the life or safety of persons, we will promptly inform the law enforcement authorities – in Germany, the Federal Criminal Police Office (Bundeskriminalamt, BKA) – and provide all information available to us.
In acute emergencies: police 110, ambulance 112. If you are in crisis yourself: TelefonSeelsorge helpline 0800 111 0 111 (free of charge, around the clock).
8. Point of contact (Art. 11 and 12 DSA)
Single point of contact for users, Member State authorities, the European Commission and the European Board for Digital Services: hallo@avolya.de. You can write to us in German or English.
