Legal
Terms and Conditions
This English translation is provided for your information. Only the German version is legally binding.
These terms set out what you receive from AVOLYA, how an order works and what both you and we must observe in the process.
For review: Draft of 19 October 2026, prepared on the basis of the actual ordering process on avolya.de. Notes like this one are hidden from the public and only visible with ?vorschau.
1. Scope and provider
- These Terms and Conditions (“Terms”) apply to all contracts that you conclude with WiAd UG (haftungsbeschränkt), Rosengarten 14, 23730 Neustadt in Holstein (hereinafter “AVOLYA” or “we”), via the website avolya.de or the AVOLYA app.
- Our offer is aimed at adult consumers. We deliver exclusively to addresses in Germany.
- Deviating terms only apply if we expressly agree to them.
2. What AVOLYA is – and what it is not
- AVOLYA is a digital platform. Through it, you can
- request a medical review by independent partner doctors,
- use the Balance and Legacy support programmes (section 8) and
- following a medical prescription, arrange for the medicine to be delivered by our partner pharmacy.
- We do not provide any medical services ourselves and are not a pharmacy. We do not prescribe, sell or deliver prescription-only medicines.
- Coaches are not doctors and do not provide medical advice. Content from the support programme, the Guide and the community does not replace medical advice.
3. Medical services
- The medical review and treatment are carried out by partner doctors licensed to practise medicine in Germany. They work independently and on their own responsibility. You conclude the treatment contract directly with the partner doctor.
- Whether treatment is an option is decided by the doctor freely and solely on medical grounds. You have no entitlement to a prescription.
- We only use an automated preliminary check of your information if you separately consent to it. You can request at any time that a doctor reviews your case instead.
- Medical services are invoiced in accordance with the German scale of fees for doctors (Gebührenordnung für Ärzte, GOÄ).
For review: At present, a single total amount is paid to WiAd UG (Stripe). It covers the medical service (GOÄ invoice in the doctor's name), the medicine and the support programme. The capacity in which WiAd UG collects the shares for the doctor and the pharmacy (own service, payment agent, debt collection) should be stated expressly here and in section 9.
4. Medicines
- If the doctor prescribes a medicine, by placing your order you instruct our partner pharmacy to procure and deliver it. The pharmacy dispenses the medicine on its own responsibility and delivers it refrigerated to your delivery address in Germany.
- The medicine is intended for you only. You must not pass it on to anyone else.
5. Customer account
- You need a customer account to place an order. Your details must be true and complete. The account is personal and non-transferable.
- Keep your login details secret. If you suspect that someone else knows them, change your password and let us know.
- You can delete your account at any time in the account settings. The data we are still required to retain afterwards is set out in the privacy policy.
6. Ordering and conclusion of the contract
- You fill in the online questionnaire, enter your delivery and billing address and confirm the treatment contract with the doctor and the dispatch order to the pharmacy. In the order summary you can see all costs and check and correct your details before submitting them.
- By clicking “Order now with obligation to pay”, you submit a binding offer.
- When you place your order, we only reserve the amount. It is only collected once a partner doctor approves the treatment. The contract is concluded upon this approval. If the doctor declines, we release the reservation; you incur no costs.
- We store the text of the contract. You can find your orders, invoices and documents in your account at any time. The language of the contract is German.
For review: Paragraph 3 ties the conclusion of the contract to the medical approval. AVOLYA does not currently send an email confirming the order (§§ 312i and 312f BGB (German Civil Code), BGB). Such a confirmation would also have to include the Terms and the withdrawal notice.
7. Following months and term
- For each further month, you submit a check-in, which the partner doctor reviews again. Each following month is a separate order. There is no subscription and no automatic renewal. Section 6, paragraph 3 applies accordingly to payment.
- If you do not submit a check-in, the support ends at the end of the current month. You do not need to cancel for this.
- The Legacy programme is also available as an annual membership with a term of 12 months.
For review: It is still open whether the annual membership is paid in advance or monthly, whether it ends automatically after 12 months and how it can be terminated early, for example if the doctor declines further treatment (Section 309 no. 9 BGB). It cannot currently be booked at checkout.
8. Balance and Legacy support programmes
- Balance includes access to the AVOLYA app with Recipe World, Movement World, the Guide and support.
- Legacy includes all Balance services. In addition, there are individual monthly plans, workouts and recipes, guidance through three phases and personal support from a coach via chat.
- Features marked as “Coming soon” on the website or in the app are not yet part of the agreed scope of services.
- With the Programme Partner feature, you can link your account with another person's account and share plans. Each person concludes their own contract and is medically reviewed individually.
- Our community guidelines apply to the community.
9. Prices and payment
- The prices shown to you before you submit your order apply. All prices are final prices in euros and include statutory VAT where applicable.
- You pay via our payment service provider Stripe using one of the payment methods offered there.
- You can find your invoices in your account.
10. Your cooperation
- Answer the questionnaire and check-ins truthfully and completely. If your state of health changes, inform the doctor.
- If you experience side effects or symptoms, contact the treating doctor. AVOLYA is not an emergency service: in an emergency, call 112.
11. Availability
We endeavour to provide the website and app with as little interruption as possible. Maintenance work, security updates and disruptions beyond our control may temporarily restrict use.
12. Liability
- We are liable without limitation in cases of intent and gross negligence, for injury to life, body or health and under the Produkthaftungsgesetz (German Product Liability Act).
- In cases of slight negligence, we are only liable if we breach an essential contractual obligation, i.e. an obligation whose fulfilment makes the contract possible in the first place and on which you may rely. In that case, liability is limited to the foreseeable damage typical for this type of contract.
- The partner doctors and the partner pharmacy are each liable for their own services.
13. Right of withdrawal
As a consumer, you have a statutory right of withdrawal. Details can be found in the withdrawal notice.
14. Data protection
We explain how we handle your data in the privacy policy.
15. Dispute resolution and final provisions
- We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
- German law applies. If your habitual residence is in another state, the mandatory consumer protection provisions of that state remain unaffected.
