Information on the right of withdrawal

As a consumer, you can withdraw from your contract with AVOLYA within 14 days. The information below follows the statutory model and therefore uses the formal form of address (“Sie”) in German.

Information on the right of withdrawal
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day of the conclusion of the contract.
To exercise your right of withdrawal, you must inform us (WiAd UG (haftungsbeschränkt), Rosengarten 14, 23730 Neustadt in Holstein, email: hallo@avolya.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we received the notice of your withdrawal from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of such reimbursement.
If you requested that the services begin during the withdrawal period, you shall pay us a reasonable amount which corresponds to the proportion of the services already provided up to the time you inform us of the exercise of the right of withdrawal with regard to this contract, in comparison with the full scope of the services provided for in the contract.
For review: the model for services (Annex 1 to Art. 246a § 1(2) EGBGB) has been used for WiAd UG's support programme. The sentence on delivery costs is omitted because WiAd UG itself does not deliver anything. Delivery of the medicinal product is handled by the pharmacy.
Exclusion and early expiry of the right of withdrawal
- Support programme: the right of withdrawal expires if we have fully performed the service and only began performance after you gave your express consent to this and at the same time acknowledged that you will lose your right of withdrawal once the contract has been fully performed.
- Medical treatment: you conclude the treatment contract with the partner doctor. The provisions on the right of withdrawal for distance contracts do not apply to treatment contracts.
- Medicinal products: the medicinal product is dispensed by the partner pharmacy. There is no right of withdrawal for goods which are liable to deteriorate rapidly or whose expiry date would quickly be exceeded. Nor is there a right of withdrawal for sealed goods which are not suitable for return due to health protection reasons if their seal has been removed after delivery.
For review: legal bases: § 356(4) BGB (service), § 312(2) no. 7 BGB (treatment contract), § 312g(2) nos. 2 and 3 BGB (medicinal products, refrigerated goods). The checkout does not currently ask for express consent to performance beginning before the withdrawal period expires. Without it, neither the expiry of the right of withdrawal nor the obligation to pay compensation for value applies. In addition, the withdrawal information must be provided on a durable medium (email) after the contract has been concluded. No such email exists yet.
